When can you Qualify for an IMI Exemption?

Did you know that some property owners may qualify for an exemption from Municipal Property Tax (IMI), provided they meet certain eligibility requirements?

In practice, there are two types of IMI exemption: temporary and permanent.

Read on to find out who qualifies, the conditions that must be met, and the situations in which this tax benefit may apply.

IMI Exemption: Who Can Benefit from Being Exempt from Municipal Property Tax?

The Municipal Property Tax (IMI) is an annual tax levied on the Taxable Asset Value (Valor Patrimonial Tributário – VPT) of properties located in Portugal.

However, certain property owners may be entitled to either a temporary or permanent exemption from this tax.

This represents a significant tax benefit for eligible property owners who meet the legal requirements. Below, we explain the main conditions for each type of exemption.

1 – Temporary IMI Exemption

The purpose of the temporary IMI exemption is to encourage specific types of real estate investment and promote the development of certain areas.

Depending on the circumstances, this exemption may be granted for a period ranging from three to ten years.

It may apply to residential, commercial, industrial, and tourism-related properties.

The most common situations in which a temporary IMI exemption may be granted include:

1.1 Urban Regeneration Projects

Properties located within officially designated urban regeneration areas may qualify for a temporary IMI exemption.

The aim is to encourage investment in the renovation and revitalization of deteriorated urban areas.

1.2 Investment in Tourism Properties

Property owners who invest in real estate intended for tourism activities – such as hotels, tourist apartments, or accommodation establishments – may also qualify for an IMI exemption.

This measure is designed to support Portugal’s tourism sector by encouraging investment.

1.3 Investment in Inland Regions 

To promote the economic development of Portugal’s inland territories, the Government offers temporary IMI exemptions for certain properties located in these regions.

The objective is to attract investment and encourage population growth outside the country’s coastal areas.

1.4 Properties of Public Interest

Certain properties officially classified as being of public or cultural interest may benefit from a temporary IMI exemption.

This measure encourages the preservation and protection of Portugal’s historical and cultural heritage.

1.5 Household Annual Gross Income

A temporary IMI exemption may also be granted based on the annual gross household income.

To qualify under this criterion:

  • The household’s annual gross income must not exceed 153,300 €
  • The property’s Taxable Asset Value (VPT) must not exceed 125,000 €

This exemption is generally granted for a maximum period of three years. However, property owners may apply for this exemption on two separate occasions, provided they continue to meet the legal requirements.

2 – Permanent IMI Exemption

A permanent IMI exemption is granted in specific circumstances and remains valid indefinitely.

However, to continue benefiting from the exemption, the property owner must continue to satisfy all the applicable eligibility requirements.

The most common situations include:

2.1 Urban Properties Classified as National Monuments or Properties of Public Interest

Properties officially classified as national monuments or properties of public interest may qualify for a permanent IMI exemption.

The purpose of this measure is to promote the preservation and conservation of Portugal’s historical and cultural heritage.

2.2 Properties used for Religious, Charitable, Educational or Healthcare Purposes

Urban properties used for religious, charitable, educational, or healthcare purposes may also qualify for a permanent exemption.

This benefit is intended to encourage the provision of essential public services and support non-profit organizations.

2.3 Household Annual Gross Income 

As with the temporary exemption, permanent IMI exemption may also be granted based on the household’s annual gross income.

To obtain an IMI exemption, you must meet the applicable legal requirements and complete the relevant administrative procedures.
